1. Acceptance of Terms
By downloading, installing, or using the My Atelier Online app (“App”), you agree to be bound by these Terms of Use (“Terms”). Please read these Terms carefully before using the App. If you do not agree to these Terms, you may not use the App.
2. App Description
My Atelier Online is a mobile application developed by IDEA Developers SHPK (“Company”) that provides users with access to various features related to art and creativity. The App may include features that require a monthly subscription plan to access premium content and additional functionalities.
3. Subscription Plans and Payments
a. Subscription Plans: The App offers monthly subscription plans with different pricing tiers. The details of each subscription plan, including its duration, cost, and features, will be provided within the App. The Company reserves the right to modify the subscription plans and their pricing at any time.
b. Payment and Billing: By subscribing to a monthly plan, you agree to pay the applicable subscription fees on a recurring basis until you cancel your subscription. Payments will be processed through the designated payment method provided by the App. You authorize the Company to charge the applicable fees to your chosen payment method. It is your responsibility to ensure that your payment information is accurate and up to date.
c. Automatic Renewal: The monthly subscription will automatically renew at the end of each billing cycle unless you cancel your subscription. The renewal will be charged to your payment method unless you cancel before the renewal date. You may cancel your subscription through the App’s settings or by contacting the Company’s customer support.
d. Free Trial: The App may offer a free trial period for new users. The terms and duration of the free trial will be specified within the App.
4. Intellectual Property Rights
a. App Ownership: The App, including its design, features, content, and underlying technology, is owned by the Company and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to the App or its content except for the limited license to use the App in accordance with these Terms.
b. User Content: By using the App, you may submit or upload user-generated content. You retain ownership of your user-generated content. However, by submitting content to the App, you grant the Company a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display your content within the App solely for the purposes of providing and improving the App’s functionality.
5. User Responsibilities
As a user of the My Atelier Online app, you are responsible for:
Complying with these Terms of Use and any applicable laws and regulations.
Maintaining the confidentiality of your account credentials and not sharing them with others.
Using the App in a lawful and responsible manner, without engaging in any unauthorized activities.
Respecting the intellectual property rights of others and not infringing on any copyrights or trademarks.
Providing accurate and up-to-date information when using the App, including during the subscription process.
Notifying the Company promptly of any unauthorized use or suspected security breaches.
6. User Restrictions
When using the My Atelier Online app, you agree to:
Not attempt to reverse engineer, decompile, or disassemble the App.
Not interfere with the operation of the App or its servers.
Not engage in any fraudulent or unlawful activities through the App.
Not use the App to distribute any harmful or malicious content.
Not access or use the App for any commercial purposes without prior written consent from the Company.
7. Termination
The Company reserves the right to terminate or suspend your access to the My Atelier Online app at any time, without prior notice or liability, for any reason, including if you breach these Terms of Use.
8. Limitation of Liability
The Company and its affiliates, directors, officers, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or other intangible losses, arising out of or in connection with your use of the My Atelier Online app.
9. Governing Law and Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of Albania. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Albania. In the event of any dispute or claim, the parties agree to attempt to resolve the matter amicably through mediation before resorting to litigation.
